Zoning Board Approves Peckham Materials Settlement Without Determining Liability

NY PLEASANT VALLEY — Zoning Board settles Peckham Materials noise violation through mutual agreement. Zoning Administrator James Patrick Lambert and Peckham Materials agreed to withdraw the noise violation citation and the company's appeal after the applicant invested $3.5 million in equipment improvements over 14 years. The settlement requires Peckham to limit night operations at its North Avenue asphalt and concrete plants to governmental projects or emergencies with advance notice, and both parties will hold quarterly meetings to discuss operations and noise mitigation.
Environmental Compliance Manager Kevin DeSilva presented post-construction noise studies showing reductions exceeding 12 decibels at reference distances, attributable to replacing a 70-foot batch tower with a drum mixer and installing acoustic barriers.
